Chapter 4. Transportations of passengers and luggage under orders

Article 27. The conclusion of the contract of chartering of a vehicle for transportation of passengers and luggage under the order

1. Transportation of passengers and luggage under the order is carried out by a vehicle provided on the basis of the contract of chartering, concluded in writing.

2. The contract of chartering specified regarding 1 present article, should include:

1) the information about freighter and charterer;

2) type of a provided vehicle (if necessary - quantity of vehicles);

3) a route and seat of supply of a vehicle;

4) a certain or uncertain circle of persons, for which transportation the vehicle is provided;

5) timeframes of performance of transportation;

6) the size of a payment for using a vehicle;

7) the order of tolerance of passengers for landing in a vehicle, established in view of requirements, the transportations of passengers stipulated by rules (in case of if the vehicle is provided for transportation of the certain circle of persons).

3. The contract of chartering specified regarding 1 present article, can include other conditions not specified regarding 2 present article.

4. At absence of an indispensability of realization of regular transportations of passengers and luggage under the order the contract of the chartering specified regarding 1 present article, consists in the form of the order on granting of a vehicle for transportation of passengers and luggage. Requisites and the order of filling of such order are established by rules of transportations of passengers.

5. In case of if the contract of chartering specified regarding 1 present article, provides granting vehicles for transportation of a uncertain circle of persons, collection of a payment from the specified persons is not supposed.

Article 28. Definition of a route of transportation of passengers and luggage under the order

Route of transportation of passengers and luggage under the order is defined by the contract of chartering if other is not established by the law.

Article 29.
Refusal of execution of the contract of chartering of a vehicle for transportation of passengers and luggage under the order or variation of such contract

1. Granting freighter a vehicle for transportation of passengers and luggage under the order, chartering mismatching treaty provisions, or with delay it is considered a unaccordance of a vehicle. In case of a unaccordance of a vehicle charterer have the right to refuse execution of the contract of chartering and to collect with freighter the penalty stipulated by a part of 2 articles of 34 present Federal laws.

2. At impossibility of realization of transportation of passengers and luggage under the order the provided vehicle in connection with its defect, accident, the similar reasons freighter in coordination with charterer it is obliged to provide other vehicle or to return paid freighter cost of using a vehicle.

Article 30. Transportation of luggage, transportation of hand luggage by a vehicle provided for transportation of passengers under the order

1. Norms of transportation of luggage, transportation of hand luggage by a vehicle provided for transportation of passengers under the order, are established freighter.

2. Freighter have the right to give up in acceptance of luggage for transportation, transportation of hand luggage if properties or packing of the things which are a part of luggage, hand luggage, do not meet the requirements, established by rules of transportations of passengers.

3. Freighterhave the right to give up in transportation of hand luggage if its accommodation in a vehicle will prevent an input of passengers in a vehicle, to an output of passengers from a vehicle.
