1. Subject matter of regulation

1. The present Federal law adjusts the attitudes arising at rendering of services by motor transport and city ground-based electric transport which form a part of a transportation system of the Russian Federation. The attitudes which connected with rendering of services by motor transport and city ground-based electric transport and have been not settled by the present Federal law, are adjusted by other federal laws and other normative legal certificates of the Russian Federation.

2. The present Federal law defines the general conditions of transportations of passengers and luggage, cargoes accordingly by buses, by trams, by trolley buses, cars, by lorries, including with use of automobile trailers, automobile semitrailer (further also - vehicles), As well as the general conditions of granting of services to passengers, charterer, shippers, consignees, to carriers, freighter on objects of transport infrastructures.

3. Transportations of passengers and luggage, cargoes motor transport in the international message are adjusted by international agreements of the Russian Federation.

4. To the attitudes connected with transportations of passengers and luggage, cargoes for personal, family, house or others not connected with realization of entrepreneurial business of needs, positions of the legislation of the Russian Federation about protection of the rights of consumers are applied also.

Article 2. Basic concepts, Used in the present Federal law

For objectives of the present Federal law following basic concepts are used:

1) luggage - the things of the passenger accepted for transportation when due hereunder;

2) the ticket - the transportation document certifying the conclusion of the contract of transportation of the passenger;

3) a cargo - material object, Accepted for transportation when due hereunder;

4) shipper - the physical or legal person who under the contract of transportation of a cargo speaks on behalf the name or on behalf of the owner of a cargo and is underlined in a transport waybill;

5) The addressee of a cargo - the physical or legal person, allocated by legitimate rights on reception of a cargo;

6) the order-order - the form of the contract of chartering;

7) the container - the equipment having volume not less of one cubic metre, suitable for repeated using and adapted for loading, a unloading of a cargo, its overload from one vehicle on other vehicle without intermediate Overloads of a cargo;

8) a route - a transit of a vehicle between points of departure and purposes;

9) a route of regular transportations - intended for realization of transportations of passengers and luggage under schedules a transit of vehicles from initial stopping item through intermediate stopping items up to Final stopping item which are certain when due hereunder;

10) objects of a transport infrastructure - constructions, the industrial-technological complexes intended for service of passengers, freighters, shipper, consignees, carriers and freighters, As well as for maintenance of work of vehicles;

11) stopping item - seat of a stop of vehicles on a route of the regular transportations, equipped for landing, landing of passengers and expectation of vehicles;

12) the passenger - the physical body, Which transportation by a vehicle is carried out on the basis of the contract of transportation of the passenger or the contract of chartering of a vehicle for transportation of the passenger;

13) a carrier - the legal person, the individual businessman, the transportations which have taken up on the contract of the passenger, To the contract of transportation of a cargo a duty to transport the passenger and to deliver luggage, as well as to transport entrusted shipper a cargo in destination and to give out luggage, a cargo commissioner on their reception to the person;

14) a travelling leaf - the document which is serving to the account and the control of work of a vehicle, the driver;

15) the schedule - the chart, Establishing time or intervals of arrival of vehicles in stopping item or departures of vehicles from stopping item;

16) hand luggage - things of the passenger which are transported by the passenger with itself in a vehicle and which safety is by transportation provided with the passenger;

17) a perishable cargo - a cargo, Which safety by transportation is provided with a vehicle by means of compliance with the certain temperature mode;

18) a special-purpose vehicle - the vehicle intended and equipped for transportation of certain types of cargoes;

19) the terminal - an industrial-technological complex, Intended for realization of the operations connected with transportations of cargoes;

20) a transport waybill - the transportation document confirming the conclusion of the contract of transportation of a cargo;

21) freighter - the physical or legal person, Which under the contract of chartering undertakes to pay cost of using of all or a part of capacity of one or several vehicles provided on one or several flights for transportations of passengers and luggage, cargoes;

22) freighter - the legal person, the individual businessman, The chartering which have taken up on the contract a duty to provide freighter all or a part of capacity of one or several vehicles on one or several flights for transportations of passengers and luggage, cargoes.

Article 3. Rules of transportations of passengers and luggage, cargoes

1. On the basis of the present Federal law the Government of the Russian Federation approves rules of transportations of passengers and luggage motor transport and city ground-based electric transport, as well as rules of transportations of cargoes motor transport.

2. Rules of transportations of passengers and luggage motor transport and city ground-based electric transport (further - rules of transportations of passengers) represent the normative legal certificates adjusting the order of the organization of various types of transportations of passengers and luggage, As well as conditions of transportations of passengers and luggage and granting of vehicles for such transportations.

3. Rules of transportations of cargoes motor transport (further - rules of transportations of cargoes) represent the normative legal certificates adjusting the order of the organization of transportations of various types of cargoes, maintenance of safety of cargoes, Vehicles, containers, as well as conditions of transportations of cargoes and grantings of vehicles for such transportations.

Article 4. Types of the message

1. Transportations of passengers and luggage, cargoes are carried out in city, suburban, intercity, the international message.

2. Transportations in the city message are carried out in borders of settlements.

3. Transportations in the suburban message are carried out between settlements on distance up to fifty kilometers inclusive between borders of these settlements.

4. Transportations in intercity the message are carried out between settlements on distance more than fifty kilometers between borders of these settlements.

5. Transportations in the international message are carried out for limits of territory of the Russian Federation or on territory of the Russian Federation with intersection of Frontier of Russia Federations, including transit through territory of the Russian Federation.


Article 5. Types of transportations of passengers and luggage

Transportation of passengers and luggage are subdivided on:

1) regular transportations;

2) transportations under orders;

3) transportations by automobile taxi.

Article 6. Travelling sheets

1. Mandatory requisites and the order of filling of travelling sheets affirm with the federal enforcement authority which is carrying out functions on development of a state policy and normative-legal regulation in area of transport, by way of, established by the Government of the Russian Federation.

2. Realization of transportations of passengers and luggage, cargoes by buses, by trams, by trolley buses, cars, by lorries without registration of a travelling leaf on an appropriating vehicle Is forbidden.

Article 7. Requirements to registration and the equipment of vehicles and objects of a transport infrastructure

Requirement to registration and the equipment of vehicles and the objects of a transport infrastructure used for transportations of passengers and luggage, are defined by rules of transportations of passengers.
